Definitions
- “Website”
means a set of web pages or resources collated under a single domain name. - “Application/Web Application”
means a script, a collection of scripts, or compiled code, written by a 3rd party or yourself; e.g., WordPress. - “Managed Application”
means an application that is installed and supported by us.

Use of Services
- You agree that your use of the website or application will be in full compliance with our Acceptable Use Policy.
- Where you upload application files to your web space (e.g., WordPress or a custom application), you do so at your own discretion, and we take no responsibility for any issues arising from the use of such scripts or any resulting loss of data.
- We limit data uploads from scripted languages (such as, but not limited to, PHP or ASP.NET) to 30MB per file and reserve the right to change that limit at any time and without prior notice.
- You may not attempt to change, bypass or otherwise manipulate any timeout, security setting, or other restriction that may be applied to our systems. Any attempt to do so will result in immediate suspension or termination of your service and/or account.
- You may not run scripts or applications which use excessive amounts of system resources, such as, but not limited to, CPU, Memory or Disk I/O. System resources may be used for serving web pages only and may not be used for background processing, data mining, data processing, any other long running process, or any process not directly related to the serving of the web page request.
- You will not use the website in any way that is detrimental to other customers or users.
Domains
- If a web site is used with a domain where we do not host the domain name records, we make no warranties as to the availability or performance of that site. We may at our discretion, at any time, and without notice, change the identifiers, including the IP address, of any website or server.
Bandwidth and Storage Limits
- Services are provided with limits to certain resources, such as disk space, database storage, bandwidth, or other limit as specified in the service description.
- Any limits may be enforced as either a “soft” limit or a “hard” limit. The type of limitation may be subject to change at our discretion and without notice.
- a “soft” limit means we will allow you continue uninterrupted and to further exceed the limit.
- a “hard” limit means that once the limit has been reached, no further data will be accepted. For example, if you reach the limit of the disk space available to you, you will be unable to upload or write to any files until you have removed some of your data to bring usage below the limit.
- Where you exceed any usage above the specified limit, we shall take the following actions:
- we shall send you a notice giving you 24 hours (the “grace period”) in which to bring down your usage to below the limit;
- following the grace period, any additional usage above the specified limit, shall be charged at the current price for that resource.
- Where a specified limit is exceeded on a regular basis, we may take appropriate action as we deem suitable, including, but not limited to applying a hard limit or suspension of the service.
- “Unlimited” quotas are subject to fair use based on average customer usage and as deemed suitable at our discretion. If you exceed fair use, we will ask you to lower your usage or upgrade your service. If you repeatedly exceed fair usage, we may at our discretion enforce a limit or suspend your service.
Performance, Availability and Security
- We monitor our servers and infrastructure constantly but do not monitor individual websites or applications.
- We make every effort to ensure your website or managed application is secure, available to you, and in working order, but may from time to time need to take websites offline for maintenance, in accordance with section 6 of our General Terms and Conditions.
- On the rare occasion where a website or managed application encounters a problem, it is your responsibility to notify us so that we can correct the problem. We cannot guarantee to be able to restore the data of any website, application, or database; and you accept no liability for the loss of any data.
- Where you upload application files to your web space (e.g., WordPress or a custom application), we make no guarantees regarding the performance or functionality of those applications.
Storage and Backups
- We shall have no liability for any loss or damage to any data stored on our servers
- We take backups of data on our servers and infrastructure for the purposes or archiving and business continuity.
- In the event of loss or damage to your data as a result of your actions or someone acting on your behalf, you shall have no access to our backups or archives.
- In the event of loss or damage to your data as a result of our actions or a failure of our infrastructure, we will make all reasonable effort to assist you in the restoration of your data but make no guarantees or warranties to the success of any restoration.
- You accept all responsibility for ensuring you have full and adequate backups of all your data.
- We reserve the right to scan your content for virus or malware infections and to remove any files, without notice, which are identified as infected or which we are unable to scan, including, but not limited to, password protected archives.
Hosting & Web Application Terms of Service
These terms and conditions apply to our Web Hosting and Web Application Services and are applicable to all users of those services. They enhance and supersede our General Terms and Conditions.
Any clause in these terms shall take precedence over a conflicting or competing clause in our General Terms and Conditions.
BY USING OUR WEB HOSTING SERVICE OR RUNNING A WEB APPLICATION, YOU AGREE TO ABIDE BY THESE TERMS.
